● Telephone Number: +31 644805507These General Terms and Conditions apply to every offer made by STUDIO PRAGYA JAIN and to all distance contracts concluded between the company and the consumer (B2C) or business buyer (B2B). The text of these General Terms and Conditions shall be made available to the client prior to the conclusion of the contract.
Article 2 – The Product, Nature, and Safety
1. Description: If an offer has a limited validity period or is made subject to conditions, this shall be explicitly stated. The images provided are a truthful representation; however, given that natural stones and minerals are utilized, minor variations in color, size, and structure are inherent to the material and do not constitute a lack of conformity.
2. Medical Disclaimer (NVWA Compliance): Our jewelry and minerals are inherently ornamental and symbolic objects. We do not attribute any medical, healing, or therapeutic properties to any of our products. Under no circumstances do these items substitute professional medical advice, diagnosis, or treatment.
3. Safety (GPSR Regulation): Certain products (such as piercings or brooches) are small in size or feature functional sharp edges. Due to choking hazards and the risk of injury, they must be kept out of the reach of unsupervised young children.
4. Composition: All our silver items carry the 925 sterling silver hallmark. We guarantee full compliance with the EU REACH Regulation regarding the legal limits for the release of heavy metals, including nickel, lead, and cadmium.
Article 3 – Prices and Payments
1. Prices: The prices displayed for the products include the 21% statutory VAT (Btw) and other government levies. Shipping costs will be clearly indicated prior to the finalization of the order.
2. Payment Methods (PSD2): STUDIO PRAGYA JAIN does not charge any additional surcharges for the use of standard consumer payment methods (such as SEPA bank transfers, iDEAL, or basic consumer credit cards).
3. Payment Obligation (Art. 7:26 BW): In consumer sales, an advance payment exceeding 50% of the total purchase amount shall not be strictly required without offering a post-payment alternative. Should the consumer voluntarily opt to pay 100% in advance via the offered payment methods, the client thereby explicitly consents to the immediate processing of the order.
Article 4 – Delivery and Execution
1. The delivery area covers the European Union. Stated delivery times are indicative.
2. STUDIO PRAGYA JAIN shall execute accepted orders with due diligence and at the latest within 30 days, unless a different delivery period has been explicitly agreed upon.
3. The risk of damage to and/or loss of the products rests with STUDIO PRAGYA JAIN until the moment of physical delivery to the consumer or a pre-designated representative.
Article 5 – Right of Withdrawal and Returns
1. The consumer has the right to dissolve the contract without giving any reason during a cooling-off period of 14 calendar days from the receipt of the product.
2. Exceptions: Custom-made or personalized products, as well as piercing jewelry (earrings, piercings) delivered in sealed packaging where the hygiene seal has been broken after delivery, are legally excluded from the right of withdrawal.
3. Return Costs: Should the client exercise their right of withdrawal, the consumer shall bear 100% of the direct costs of returning the product to our warehouse.
4. Depreciation of Value: During the cooling-off period, the client shall handle the product and its packaging with due care, limiting the inspection to what would reasonably be allowed in a physical retail store. The client is legally liable for any diminished value of the product resulting from handling that goes beyond what is strictly necessary. If the product is returned damaged, used, or broken after a prolonged period, [Company Name] reserves the right to deduct the depreciation in value from the refund, which may amount to up to 100% of the purchase price.
Article 6 – Legal Guarantee and Complaints
1. Legal Guarantee (Conformity): STUDIO PRAGYA JAIN guarantees that the products comply with the contract, the specifications stated in the offer, and reasonable requirements of reliability and usability.
2. Complaints: Complaints regarding the execution of the contract or product defects must be submitted to STUDIO PRAGYA JAIN fully and clearly described within a minimum period of 2 months after the consumer has discovered the defect.
3. Submitted complaints will be answered within a period of 14 working days from the date of receipt.
4. If a complaint cannot be resolved by mutual agreement, the EU consumer may submit their dispute through the European Commission's Online Dispute Resolution (ODR) platform.
Article 7 – Privacy and Intellectual Property
1. The processing of the buyer's personal data shall be carried out in strict compliance with the General Data Protection Regulation (GDPR/AVG). Details regarding how we collect, use, and protect your data are outlined in our separate Privacy Policy.
2. All texts, images, designs, and logos on this website and in our commercial communications are the exclusive intellectual property of STUDIO PRAGYA JAIN and may not be copied, reproduced, or used without express written authorization.
Article 8 – Applicable Law Contracts between STUDIO PRAGYA JAIN and the client to which these General Terms and Conditions apply shall be governed exclusively by the laws of the Netherlands.
